Dilapidations Claim - Industrial Manufacturing Facility

Settling a dilapidations claim on behalf of a landlord can be a complex and time-consuming process. Recently, we had the opportunity to represent a landlord in settling a dilapidations claim on a furniture manufacturing site in Yorkshire, England.


We conducted a thorough inspection of the property to identify any areas of disrepair. This involved examining the buildings, machinery, and equipment to assess their condition and identify any potential areas of damage. We also reviewed the terms of the lease to ensure that we had a clear understanding of the landlord's obligations and the tenant's responsibilities. 


Based on our inspection and review of the lease, we prepared a schedule of dilapidations that detailed the repairs and improvements required to bring the property back to its original condition. This included repairs to the roof, replacement of broken windows, and repair of the electrical and plumbing systems. Once the schedule of dilapidations was complete, we served it on the tenant and entered into negotiations with them to reach a settlement.


This involved discussing the repairs and improvements required and determining the most cost-effective and practical way to address them. Through these negotiations, we were able to reach a settlement that was acceptable to both parties. This involved the tenant carrying out certain repairs and improvements themselves and paying a financial contribution towards the remaining works. 


One of the key lessons we learned during this process was the importance of clear communication between all parties involved. This included regular updates to the landlord on the progress of negotiations and ensuring that the tenant has a clear understanding of the repairs and improvements required. We also learned the importance of being flexible and open to compromise during negotiations. This allowed us to find a settlement that was practical and cost-effective while also addressing the contractual obligations.  


Settling a dilapidations claim on behalf of either party, can be a complex and challenging process. The support of a surveyor can benefit in decision-making, when considering managing commercial property investments.
